Terms and Conditions

 
1.      Definitions:

 Selpaw Services ("Selpaw"), as supplier and seller of computer components and peripherals and the manufacturer of computer systems, provides goods and warranties according to the conditions as described below.

 2.     Pricing Policy:

          All prices quoted are inclusive of GST. Prices are subject to change without notice. Omissions and errors are excepted
                Terms are cash on pick-up or on delivery unless prior arrangements have been made. Cheques not cleared on first presentation will incur a bank and handling fee of $22.00.

3.        Delivery:

Subject to stock availability and in accordance with the payment conditions outlined above, component orders shall be despatched the following working day after the receipt of purchase order. Subject to stock availability and in accordance with the payment conditions outlined above, system orders will be despatched 3 working days after receipt of purchase order. Notification of courier pickup deadline must be received a minimum of 3 hours prior to pick-up. All freight costs will be borne by the purchaser. These costs may include insurance, import and export duties, and any other fees or charges imposed by government agencies or officials. The purchaser is responsible for any loss or damage to goods in transit by any courier or postal service.

            Goods ordered for customer pick-up will only be held for five business days unless prior arrangements have been made.

Non defective goods may be returned for credit within 7 days of invoice. Goods must be in resaleable condition and be returned in their original packaging and accompanied by a copy of the original invoice. A credit for the original invoice value less a 15% restocking fee will be issued against your account. No returns of non-defective goods are accepted after 7 days from invoice.

     Defective component(s) or system(s) within their respective warranties may be returned to Selpaw subject to the conditions outlined below:
     1. Returned goods must be accompanied with a copy of the original invoice.
     2. If you are shipping a system or a hard drive or other device containing data, you are responsible for backing up such data prior to shipment. Selpaw will not be                             responsible for data lost during the course of shipment, repair or replacement.
    3. All costs of returning defective parts or systems to Selpaw, including insurance, must be paid by the purchaser.
    4. If Selpaw determines that failure of the part(s) or system(s) was not a result of a defect in materials or workmanship, Selpaw reserves the right to charge you for parts and             labour at Selpaws then current labour rate. A minimum charge of $22.00 will apply to items returned for warranty and no fault is found. Selpaw will advise you prior to                 assessing these charges.

5.             Selpaw Services reserves the right to alter or change these Terms and Conditions without further notice.

6.             Selpaw Services remain the legal and beneficial owner of goods delivered to the Customer and Property in the goods shall not pass to the Customer until payment by the Customer to Selpaw Services of all money owing by the Customer to Selpaw Services.

7.             One-year Limited Return to Base (RTB) System Warranty:

Selpaw warrants that the hardware (but not the software) included in the purchased system will be free from defects in materials and workmanship for one (1) year from the date of invoice.

 Third-party hardware ("Peripherals") external to the System (including: printers, joysticks, game pads, speakers, digital cameras etc.) are covered by their respective manufacturers warranties, not by Selpaw. Please refer to the warranty documentation that accompanies the Peripheral for details.

8.             Component Warranty:

Unless specified otherwise, warranty on all components is one-year parts and labour return to base (RTB).

 
9.             Peripheral Warranty:

Warranty on peripherals is (e.g. is multimedia hardware, mice, modems, printers) shall be as per their individual manufacturers warranty terms.

10.           Software Warranty:

All supplied OEM software products carry a 90-day warranty from the date of purchase. If the software fails from misuse or hard drive failure, the warranty is void.

11.           Terms of Limited Warranties:

Limited Warranties become effective on the date of shipment from Selpaw, are granted to the initial end-user only and are non-transferable. Removal of hardware from a System and use of such hardware in a different system or configuration voids all applicable limited warranties. Any claims under these warranties must be made before the end of the applicable warranty period. During such period, if Selpaw determines that a part or system is defective in material or workmanship, Selpaw, at its option, will provide you with a repaired part or system or replace any part or system that is covered by the applicable warranty. Selpaw reserves the right to substitute functionally equivalent new or serviceable reconditioned parts and systems. Selpaws responsibility is limited to repair or replacement, either of which may be selected by Selpaw at their sole discretion. Limited Warranties cover only defects arising under normal use and do not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature, unusual temperatures or humidity, improper installation, or damage as determined by Selpaw to have been caused by the customer, or repairs made by anyone other than Selpaw or you with the assistance of Selpaw technical support.

12.           Limitations of Limited Warranties:

Selpaw make no warranty whatsoever with respect to software included in any system sold by Selpaw, and all software is sold "as is" and "with all faults." IN NO EVENT SHALL SELPAW BE LIABLE TO YOU OR ANY THIRD PARTY FOR LOST PROFITS OR OTHER SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, LOSSES, COSTS OR EXPENSES OF ANY KIND, HOWEVER CAUSED, AND WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY OF LIABILITY REGARDLESS OF WHETHER SELPAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES, COSTS OR EXPENSES. EXCEPT AS SET FORTH HEREIN, SELPAW MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, AND DISCLAIM AND NEGATE ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND CONFORMITY TO MODELS OR SAMPLES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
